Town Officials Reject Carlson Associates' Site Plans

Plans for Old Northport Road site lack crucial details, a 'stall tactic," Smithtown officials say.

Smithtown Town officials have rejected last-minute site plans submitted by a Kings Park developer in attempts to abide by court orders. 

Smithtown officials say Toby Carlson, of Carlson Associates, submitted site plans to the town's Planning Department by the court-imposed deadline of June 19, but the plans are ambiguous and lack necessary, Newsday reports.

Carlson Associates pled guilty to four town summonses of property maintenance in March and paid a $1,000 fine. As part of the court settlement, Carlson was to file a site plan for his 45-acre site on Old Northport Road by June 19 and obtain the necessary approvals by November. 

The plans were delivered on June 19, but they have come under fire. 

Supervisor Patrick Vecchio told Newsday ""appears to be . . . a stall tactic, with a submission that has no basis in reality . . . The submission does not meet the definition of a site plan."

Frank DeRubeis, Smithtown's Planning Director, said the Carlson submitted plans but the plans lack many crucial details, such as what building materials will be used in construction. 

Carlson Associates has a pending application before Smithtown Board of Zoning Appeals for a change of zone from a mix of residential and light industrial to heavy industrial, to bring their current businesses practices into compliance with town code. 

The public hearing on the change of zone application, originally scheduled for Sept. 5, 2012, was postponed to Nov. 21, 2013.
