Window Stops Work at Soon-To-Be Deli

Owner of the deli says work was stopped because of a window he wants to install that has not yet been approved.

A stop work order has been issued by the Town of Smithtown at the former home of  on West Main Street, the soon-to-be home of Nino's Delicatessen.

The stop work order, according to deli owner Anthony Garofalo, is only for work done on the building's exterior because of a variance needed to install a window.

"[Work was stopped] only on the outside because I need a variance for a window. I'm trying to put a side window up on the side of the building and it didn't get approved yet. I thought it did," he said. 

Garofalo said he would meet with the state code official and the work stoppage could be rectified as soon as Thursday.

If the installation of the window does not get approved Garofalo said he will remove the window's installation from his permit so he could continue to work on the exterior of the building.

OR SPECIAL EXCEPTION....ALL OVER A WINDOW ??....& WILL TAKE MANY MONTHS, & MANNNY $$$ TO GET APPROVED...SUCH A WASTE ALL OVER A WINDOW.... ITS CALLED RED TAPE B.S.....I SAY PUT THE WINDOW IN & DEAL WITH THE PROBLEM LATER....OR FORGET ABOUT IT ALL TOGETHER....BUILDERS CHOICE.....SO MUCH CONCERN OVER SOMTHING SO SMALL

Well woody I'll agree with you they should just forget the window and Move on. They can frame the opening for the window and then cover it. If they feel they really need it they can apply for the variance at a later date and would be a easy install. No reason to hold up the construction. Are you sure that the install of the window was the building depts. only concern? I know you feel that it's only a window but think of it this way....what if (and I'm not saying it is) the window was a infringement on sub sides neighbor. It looks like the body shops property goes right to the sub side building. Codes are there to protect neighbors and also to protect applicants from builders who may be cutting corners. Maybe after further review the building dept could move this issue along for the applicant. I agree of the issue was only a window then they should try to work with the applicant.

just re-read the story, i didnt relize the stop work order was for outside work only. they can continue to work indoors.

AND......THE ISSUE WOULD BE WITH THE PLANNING DEPT, NOT THE BLDG DEPT, BUT....ENFORCED BY THE BLDG DEPT......SO MUCH HUB-BUB OVER SOMETHING SO STUPID....BUT THAT'S HOW IT IS, WHEN IT COMES TO GOVT....LOTS OF RED TAPE

again, codes are there for a reason. just because you think its stupid doesnt mean its not nessesary.
