KPE II, Gesuale Talk of Redeveloping Land for Residential Use

Town of Smithtown's court case against KPE II is adjourned until Oct. 22.

Kings Park industrial business owners has announced they are willing to redevelop their land for residential use, bringing it in line with Town of Smithtown's zoning codes. 

KPE II's owners have said they are willing to work with Tom and Margaret Gesuale, to redevelop their land along Old Northport Road for residential use, Times of Smithtown reports. 

Jezco Bulk Removal recently relocated their business from Old Northport Road to 2013 Jezco Bulk Removal has been operating at its new location at 273 East Main Street in Yaphank as of July 22. 

"In order to accommodate the citizens of Kings Park, we have completely moved our business to a new location," John Gesuale said in email dated July 22.

However, his parents, Tom and Margaret, continue to lease land in Kings Park to companies who are still operating industrial businesses. 

Smithtown Planning Director Frank DeRubeis has met with Tom Gesuale's attorney, and told him, "we will not entertain a residential portion of that particular area unless the KPE II site also does residential," according to the Times. 

DeRubeis has recommended some small portion of their land be redeveloped for residential use with condos, another small section for commercial business. A large portion of two Kings Park properties cannot be redeveloped due to sand mining. 

The Town of Smithtown's court case against KPE II has been adjourned until Oct. 22 due to this development. 

KPE II,  a pre-cast concrete business along Old Northport Road, has been brought to New York State Supreme Court by Town of Smithtown officials for violating town zoning codes on their property, which is split between light industrial and residential.

Supreme Court judge Ralph Gazzillo granted Smithtown town attorney John Zollo a temporarily restraining order against KPE II, a pre-cast concrete business who allegedly has composting waste off Old Northport Road, on March 4.

Zollo told The Times the temporary restraining order will be kept in place and the town will continue to pursue permanent injunctions to prevent KPE II from operating until an agreement is reached between the two property owners.
